Art. 61 - European patent applications filed by non-entitled persons

Article 61 European patent applications filed by non-entitled persons					- cf. Protocol on Recognition	Guidelines C IX 2.1 H IV 2.4.3

(1) If by a final decision it is adjudged that a person other than the applicant is entitled to the grant of the European patent, that person may, in accordance with the Implementing Regulations:					J6/03	A II 2. A IV 2.1

a) prosecute the European patent application as his own application in place of the applicant,						A IV 2.6 D I 6.

b) file a new European patent application in respect of the same invention; or					G 2/10	H III 4.3.1 A IV 2.7

c) request that the European patent application be refused.						A IV 2.8

(2) Article 76, paragraph 1, shall apply mutatis mutandis to a new European patent application filed under paragraph 1(b).					R.36(2)	A IV 2.7 A VII 1.3
